1. Agreement to Terms

Welcome to AgentLink ("Company," "we," "our," or "us"). By accessing or using our AI-powered real estate marketing platform at agentlink.cc (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Service.

PLEASE READ THESE TERMS CAREFULLY BEFORE USING OUR SERVICE.

2. Acceptance of Terms

By creating an account, accessing, or using the Service, you:

  1. Acknowledge that you have read and understood these Terms
  2. Agree to be bound by these Terms and our Privacy Policy
  3. Represent that you are at least 18 years old and legally capable of entering into binding contracts
  4. Represent that you have the authority to bind any company or entity on whose behalf you are acting

3. Description of Service

AgentLink provides an AI-powered platform for real estate professionals that includes:

  • AI-generated property video creation
  • Automated lead engagement and follow-up systems
  • Marketing tools and content generation
  • Customer relationship management features
  • Analytics and reporting tools

We reserve the right to modify, suspend, or discontinue any part of the Service at any time with or without notice.

4. Account Registration and Security

4.1 Account Creation

To use certain features of the Service, you must create an account. You agree to:

  • Provide accurate, current, and complete information during registration
  • Maintain and promptly update your account information
  • Keep your password secure and confidential
  • Notify us immediately of any unauthorized access or security breach
  • Accept responsibility for all activities that occur under your account

4.2 Account Eligibility

You may not create an account if:

  • You have been previously banned from the Service
  • You are prohibited by law from using the Service
  • Your account was previously terminated for violation of these Terms

5. User Content and Conduct

You retain ownership of all content you upload, create, or submit through the Service ("User Content"). By submitting User Content, you grant us a worldwide, non-exclusive, royalty-free, transferable license to:

  • Use, reproduce, modify, and adapt your User Content
  • Display and distribute your User Content in connection with the Service
  • Create derivative works based on your User Content (e.g., AI-generated videos)
  • Perform the Service you have requested

This license continues even after you stop using the Service, but only for content you have chosen to make public or share.

5.2 Content Standards

You agree that your User Content will not:

  • Infringe any third-party intellectual property, privacy, or other rights
  • Contain false, misleading, or fraudulent information
  • Contain malicious code, viruses, or harmful components
  • Violate any applicable laws or regulations
  • Contain hate speech, harassment, or discriminatory content
  • Contain pornographic, obscene, or offensive material
  • Promote illegal activities or violence
  • Impersonate any person or entity
  • Spam, phish, or engage in other deceptive practices

5.3 Prohibited Uses

You agree not to:

  • Use the Service for any illegal purpose
  • Attempt to gain unauthorized access to the Service or other accounts
  • Interfere with or disrupt the Service or servers
  • Reverse engineer, decompile, or disassemble any part of the Service
  • Use automated systems (bots, scrapers) without our permission
  • Remove or modify any proprietary notices or labels
  • Resell, redistribute, or provide the Service to third parties
  • Use the Service to compete with us or develop competing products

5.4 Content Monitoring

We have the right, but not the obligation, to:

  • Monitor, review, or remove any User Content
  • Investigate violations of these Terms
  • Take appropriate legal action against violators
  • Cooperate with law enforcement authorities

However, we are not responsible for monitoring all User Content and make no guarantees regarding content accuracy or appropriateness.

6. Intellectual Property Rights

6.1 Our Intellectual Property

The Service and its original content, features, and functionality are owned by AgentLink Inc. and are protected by:

  • International copyright laws
  • Trademark laws
  • Patent laws
  • Trade secret laws
  • Other intellectual property rights

Our trademarks, service marks, and logos may not be used without our prior written consent.

6.2 AI-Generated Content

Content generated by our AI tools ("AI Content") is subject to the following:

  • You own the output of AI-generated videos and marketing materials created with your input
  • We retain rights to the underlying AI models, algorithms, and technology
  • You are responsible for ensuring AI-generated content complies with all applicable laws
  • You must have proper rights to all input materials (images, text, data) used to generate AI content

6.3 Feedback

If you provide us with feedback, suggestions, or ideas about the Service, we may use them without any obligation to you. You grant us all rights to such feedback and waive any claims related to its use.

7. Subscription Plans and Payment

7.1 Subscription Plans

We offer various subscription plans with different features and limitations. Plan details, including:

  • Features and usage limits
  • Pricing and billing terms
  • Trial periods (if applicable)

are described on our website and may change from time to time.

7.2 Billing and Payment

By subscribing to a paid plan, you agree to:

  • Pay all fees associated with your chosen plan
  • Provide valid payment information
  • Authorize us to charge your payment method automatically
  • Pay all applicable taxes

7.3 Automatic Renewal

Subscriptions automatically renew at the end of each billing cycle unless:

  • You cancel before the renewal date
  • We terminate your account
  • The Service is discontinued

You will be charged the then-current rate for your plan upon renewal.

7.4 Cancellation and Refunds

  • You may cancel your subscription at any time through your account settings
  • Cancellation takes effect at the end of the current billing cycle
  • You will retain access to paid features until the end of the paid period
  • Refunds are generally not provided, except:
    • As required by law
    • Within 14 days of initial purchase (if no significant use of the Service)
    • At our sole discretion for service issues

7.5 Fee Changes

We may change our fees with at least 30 days' notice. Fee changes will take effect at the start of the next billing cycle after the notice period.

7.6 Overdue Payments

If payment fails:

  • We will attempt to charge your payment method again
  • Your access to the Service may be suspended
  • Your account may be terminated after 30 days of non-payment
  • You remain responsible for all unpaid fees

  • Merchantability: The Service is fit for a particular purpose
  • Non-Infringement: The Service does not infringe third-party rights
  • Accuracy: Content generated by AI is accurate or reliable
  • Availability: The Service will be uninterrupted or error-free
  • Security: The Service is completely secure or free from viruses

WE DO NOT WARRANT THAT:

  • The Service will meet your requirements
  • Results obtained from the Service will be accurate or reliable
  • Errors or defects will be corrected
  • The Service will be available at all times

YOU USE THE SERVICE AT YOUR OWN RISK.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, AGENTLINK INC., ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR:

10.1 Types of Damages

  • Indirect, incidental, special, consequential, or punitive damages
  • Loss of profits, revenue, data, or business opportunities
  • Loss of use or goodwill
  • Service interruptions or data loss
  • Damages arising from third-party services or content

10.2 Cap on Liability

OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATED TO THE SERVICE SHALL NOT EXCEED THE GREATER OF:

  1. $100 USD, or
  2. The amount you paid us in the 12 months preceding the claim

10.3 Exceptions

Some jurisdictions do not allow limitations on implied warranties or exclusion of certain damages. In such jurisdictions, our liability is limited to the fullest extent permitted by law.

11. Indemnification

You agree to indemnify, defend, and hold harmless AgentLink Inc., its affiliates, and their respective officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising from or related to:

  1. Your use or misuse of the Service
  2. Your violation of these Terms
  3. Your User Content or any content you post
  4. Your violation of any third-party rights, including intellectual property rights
  5. Your violation of any applicable laws or regulations
  6. Any negligent or wrongful conduct by you

12. Dispute Resolution and Arbitration

12.1 Informal Resolution

Before filing a claim, you agree to contact us at op@agentlink.cc to attempt to resolve the dispute informally for at least 30 days.

12.2 Binding Arbitration

If informal resolution fails, you agree that disputes will be resolved through binding arbitration rather than in court, except:

  • Small claims court disputes (under jurisdictional limits)
  • Intellectual property disputes
  • Claims for injunctive or equitable relief

12.3 Arbitration Rules

Arbitration will be conducted by a recognized arbitration organization under its rules, which include:

  • The arbitration shall be conducted in English
  • Each party bears its own costs unless otherwise awarded by the arbitrator
  • The arbitrator's decision is final and binding
  • Judgment on the award may be entered in any court of competent jurisdiction

12.4 Class Action Waiver

YOU AGREE THAT DISPUTES MUST BE BROUGHT ON AN INDIVIDUAL BASIS ONLY, AND MAY NOT BE BROUGHT AS A CLASS ACTION, COLLECTIVE ACTION, OR REPRESENTATIVE ACTION. You waive any right to have disputes resolved as a class, collective, or representative action.

12.5 Exceptions

Either party may seek injunctive or equitable relief in court for intellectual property infringement or unauthorized access to the Service.

13. Governing Law and Jurisdiction

13.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of Your Jurisdiction - to be specified based on company registration, without regard to its conflict of law principles.

13.2 Jurisdiction

Subject to the arbitration provisions above, you agree to submit to the personal and exclusive jurisdiction of the courts located in Your Jurisdiction - to be specified.

13.3 International Users

If you access the Service from outside Your Country, you are responsible for compliance with local laws and regulations. We make no representation that the Service is appropriate or available for use in all jurisdictions.

14. Export Controls

You agree to comply with all applicable export and import laws and regulations. You represent that you are not:

  • Located in a country subject to a U.S. government embargo or designated as a "terrorist supporting" country
  • Listed on any U.S. government list of prohibited or restricted parties

15. Force Majeure

We shall not be liable for any delay or failure to perform resulting from causes outside our reasonable control, including but not limited to:

  • Natural disasters or acts of God
  • War, terrorism, or civil unrest
  • Government actions or regulations
  • Internet service provider failures or delays
  • Cyberattacks or security incidents
  • Pandemics or public health emergencies

16. Modifications to Terms

We reserve the right to modify these Terms at any time. When we make changes, we will:

  1. Update the "Last Updated" date at the top
  2. Post the new Terms on this page
  3. Notify you via email or in-app notification (for material changes)
  4. Provide at least 30 days' notice for material changes

Your continued use of the Service after changes take effect constitutes acceptance of the new Terms. If you do not agree to the modified Terms, you must stop using the Service.

17. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to reflect the parties' intent to the extent permitted by law.

18. Entire Agreement

These Terms, together with our Privacy Policy and any additional terms you agree to when using specific features, constitute the entire agreement between you and AgentLink Inc. regarding the Service and supersede all prior agreements and understandings.

19. No Waiver

Our failure to enforce any right or provision of these Terms shall not be deemed a waiver of such right or provision. Any waiver must be in writing and signed by an authorized representative of AgentLink Inc.

20. Assignment

You may not assign or transfer these Terms or your rights and obligations under them without our prior written consent. We may assign these Terms without restriction. Any attempted assignment in violation of this section is void.

The following sections shall survive termination of these Terms or your use of the Service:

If you are a licensed real estate agent or broker, you represent that:

  • You maintain all required licenses and certifications
  • You will comply with all applicable real estate laws and regulations
  • You are responsible for ensuring all marketing materials comply with fair housing laws
  • You have proper authorization to market all properties featured in your content

23.2 Agencies and Teams

If you are using the Service on behalf of an agency or team:

  • You have authority to bind your organization to these Terms
  • You are responsible for all team members' use of the Service
  • You must ensure all team members comply with these Terms
  • You are liable for all fees incurred by your team

23.3 Developers and API Users

If you access our API or developer tools:

  • You must comply with our API Documentation and Usage Guidelines
  • You must not exceed rate limits or abuse the API
  • You must properly attribute AgentLink when required
  • We may terminate API access at any time for violations

24. Beta Features and Testing

From time to time, we may offer beta features or services. For beta features:

  • They are provided "as is" with no warranties
  • They may be discontinued at any time without notice
  • Your feedback may be used to improve the Service
  • Additional terms may apply to specific beta programs
